Chat2Sim — Terms of Service

By using Chat2Sim ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

IMPORTANT: Simulation Results do not constitute professional engineering advice, certification, or validation. You must independently verify all results before any real-world application, especially safety-critical decisions. See Section 4 for details.


1. The Service

1.1 What Chat2Sim Does

Chat2Sim is an AI-powered physics simulation platform. You describe your simulation needs in natural language, and our AI agent automatically configures, executes, and delivers simulation results across physics domains including fluid dynamics, structural mechanics, heat transfer, electromagnetics, acoustics, and multiphysics problems.

The AI agent makes automated judgments about solver selection, mesh generation, physical model selection, boundary conditions, and numerical schemes based on its interpretation of your input.

1.2 Obligation of Means

We are committed to an obligation of means, not results. Simulations are numerical approximations that may differ significantly from real-world behavior. We do not guarantee accuracy, convergence, or fitness for any purpose.

1.3 Accuracy Levels

If we offer different simulation tiers, each represents a different expected accuracy level:

  • Quick: Order-of-magnitude. For early-stage exploration only.
  • Standard: Intermediate. Captures primary physical phenomena for design iteration.
  • High-Fidelity: High resolution, but still requires independent validation for certification or safety-critical use.

These are comparative indications, not guarantees.

1.4 Eligibility

You must be at least 18 years old to use the Service.


2. Your Account

You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information and notify us immediately of any unauthorized access. We may suspend or terminate accounts for breach of these Terms.


3. Your Responsibilities

3.1 Input Accuracy. You are solely responsible for the accuracy and completeness of your simulation descriptions and uploaded data. We are not liable for results produced from incorrect or incomplete inputs.

3.2 Configuration Review. We make the AI-generated simulation setup available for your review before execution. You should verify it matches your intent. If you proceed without reviewing, you accept responsibility for any discrepancies.

3.3 Validation of Results. You must independently validate Simulation Results against benchmarks, experimental data, or professional judgment before any real-world application.

3.4 Legal Compliance. You must ensure your use of the Service complies with all applicable laws, including export control regulations (ITAR, EAR, EU Dual-Use Regulations) and industry standards.

3.5 No Misrepresentation. You must not represent AI-generated results as independently certified or professionally validated engineering analysis unless such validation has actually been performed.


4. No Professional Engineering Advice

Simulation Results are generated by automated AI and computational solvers. They have not been reviewed by a licensed engineer. We are not an engineering consultancy.

You acknowledge that AI-generated configurations may contain errors including incorrect boundary conditions, inappropriate mesh resolution, unsuitable physical model selection, incorrect material properties, non-converged solutions, and physically implausible results.

For safety-critical applications, you must conduct physical testing or obtain independent professional engineering review before taking any real-world action based on Simulation Results.


5. AI Limitations

The AI agent may misinterpret your intent, especially with ambiguous or underspecified descriptions. Automated mesh generation, solver selection, and physical model selection are best-effort and may not be optimal. Simulations may fail to converge, diverge, or produce non-physical results. The AI does not guarantee detection of all input errors or physical inconsistencies.


6. Intellectual Property

6.1 Your Content

You retain ownership of all data, geometry, models, and files you upload. By uploading, you grant us a limited license to process your content solely to provide the Service. You represent that you own or have rights to all content you submit and that it does not infringe any third-party rights.

6.2 Simulation Results

You own the Simulation Results generated from your inputs. We claim no ownership over outputs derived from your content.

6.3 Our Platform

The Chat2Sim platform, AI models, algorithms, and proprietary technology are our exclusive property. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service. You may not reverse-engineer, decompile, or extract any component of the Service.

6.4 Open-Source Components

The Service utilizes open-source solvers (such as OpenFOAM, FEniCS, CalculiX, and others) under their respective open-source licenses. If you download generated case files, the solver-specific components remain subject to their applicable open-source licenses. See our Open-Source Attributions page at [URL] for details.

6.5 Feedback

Any feedback or suggestions you submit may be used by us without restriction or compensation.


7. Data and Confidentiality

7.1 Data Processing

Your content is processed on our infrastructure, which may be hosted by third-party cloud providers. By using the Service, you consent to processing in the jurisdictions where we or our providers maintain facilities.

7.2 Data Retention

Simulation Results remain available for download for [30] calendar days. After that, we may delete them without notice.

7.3 Confidentiality

We treat your content as confidential and will not disclose it to third parties except: (a) to employees and subprocessors on a need-to-know basis under equivalent confidentiality obligations; (b) as required by law; or (c) with your consent. This obligation lasts for three (3) years from the date of disclosure. Standard exceptions apply for publicly known information, independently developed information, and information rightfully obtained from third parties.

7.4 Data for Service Improvement

We may use anonymized, aggregated data to improve the Service. You may opt out by contacting us. Free Tier users: see Section 8.4 for additional terms.

7.5 Privacy

Your use of the Service is subject to our Privacy Policy at [URL].


8. Billing and Usage

8.1 Pricing

Fees are determined by your chosen plan and described on our website. All fees are non-refundable except as stated in these Terms.

8.2 Usage Limits

We may impose limits on simulation size, duration, concurrency, and storage. We may terminate runaway simulations without prior notice.

8.3 Failed Simulations

System-caused failures may receive credit at our discretion. Failures caused by your input errors are billed normally.

8.4 Free Tier

If offered, the Free Tier is subject to: limited usage; results and models may be made publicly accessible; your data may be used for AI training; and we may terminate Free Tier access at any time without notice.

8.5 Cancellation

Once a simulation begins processing, it cannot be cancelled or refunded.


9. Prohibited Uses

You must not:

(a) use the Service for any unlawful purpose;

(b) reverse-engineer, extract, or attempt to derive our AI model weights or algorithms;

(c) attempt prompt injection or adversarial manipulation of the AI agent;

(d) submit inputs designed to cause excessive resource consumption;

(e) resell or white-label results as certified engineering analysis;

(f) upload malware or malicious code;

(g) share account credentials; or

(h) use the Service to circumvent safety standards or regulations.

9.1 Ethics-Based Refusal

We reserve the right to refuse any simulation that conflicts with our values, including simulations related to weapons, illegal activities, or applications we consider unreasonably harmful. In such cases, we will reimburse fees paid minus costs incurred.


10. Export Controls

You represent that your use complies with all applicable export control laws (ITAR, EAR, EU Dual-Use Regulations, sanctions programs). You must not submit export-controlled data unless under a separate written agreement with us. You represent that you are not located in an embargoed country or on any sanctioned persons list.


11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT SIMULATION RESULTS WILL BE ACCURATE, CONVERGED, OR PHYSICALLY PLAUSIBLE.


12. Limitation of Liability

12.1 Liability Cap

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (a) THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (b) USD $100.

12.2 Exclusion of Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES; PHYSICAL HARM OR PROPERTY DAMAGE FROM RELIANCE ON SIMULATION RESULTS; OR DAMAGES FROM INCORRECT, NON-CONVERGED, OR NON-PHYSICAL RESULTS. THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY.

12.3 Claim Time Limit

Claims must be submitted within six (6) months from when the damage occurred.

12.4 Jurisdictional Variations

Some jurisdictions do not permit exclusion of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.


13. Indemnification

You agree to indemnify and hold us harmless from claims arising from: (a) your reliance on results without independent verification; (b) your breach of these Terms; (c) your violation of export control laws; (d) misrepresentation of results as certified analysis; (e) infringement claims from your content; or (f) third-party claims arising from products or systems you built using Simulation Results.


14. Service Changes

We may modify, suspend, or discontinue the Service at any time without liability. We may update the AI agent, solvers, or infrastructure, which may affect result reproducibility.


15. Termination

You may terminate by closing your account. We may terminate or suspend access immediately for breach. Upon termination, you have [30] days to download your data before we may delete it.

15.1 Result Inspection

If results are not in conformity with your request, you must contact us within fourteen (14) calendar days. Using results you know are non-conforming dismisses us from liability for consequences.

15.2 Technical Termination

We may refuse a simulation for technical reasons. If the failure is our fault, we refund the affected simulation. If it is caused by your non-compliant input, we do not.


16. Changes to These Terms

We may modify these Terms with at least fourteen (14) calendar days' notice via email or on-site notification. Continued use after the effective date constitutes acceptance. If you disagree, you may terminate within the notice period. Changes do not affect simulations already in progress.


17. Governing Law and Disputes

These Terms are governed by the laws of [Jurisdiction]. Before formal proceedings, you agree to attempt informal resolution for at least thirty (30) days. All disputes are subject to the exclusive jurisdiction of the courts of [Jurisdiction].


18. General

Severability. If any provision is unenforceable, the rest remains in effect. The parties will negotiate in good faith to replace invalid provisions.

No Waiver. Failure to enforce a right does not waive it.

Assignment. We may assign these Terms. You may not without our consent.

Force Majeure. We are not liable for failures beyond our reasonable control.

Hardship. If unforeseen events fundamentally change the balance of these Terms, the parties shall negotiate in good faith to restore equilibrium.

Notices. We will send notices to the email associated with your account.

Language. In case of conflict between translations, the English version prevails.
